Arrest
On July 27, 2015 the Cass County Sheriff’s Office arrested Marc Edward Ernst, 39, of Bridgewater, IA, on a charge of Theft 5th Degree. Ernst was taken to the Cass County Jail where he was released later that day on his own recognizance.

On July 25, 2015, the Cass County Sheriff’s Office arrested Devin Sparks Register, 25, of Atlantic, IA, on an Atlantic Police Department warrant for Theft 5th Degree. Register was taken to the Cass County Jail where he was released later that day on $325 bond.

On July 24, 2015, the Cass County Sheriff’s Office arrested Mark Alan Fredericksen, 24, of Atlantic, IA, on a Cass County warrant for Failure to Appear and a charge of Driving While Revoked. Fredericksen was taken to the Cass County Jail where he was released the following day on his own recognizance.

On July 23, 2015, the Cass County Sheriff’s Office arrested Kameo Margaret Smith, 38, of Exira, IA, on an Atlantic Police Department warrant for Theft 4th Degree. Smith was taken to the Cass County Jail where she was later released on $1000 bond.

On July 21, 2015, the Cass County Sheriff’s Office arrested David Duane Kirchner, 50, of Atlantic, IA, on charges of Possession of a Controlled Substance and Prescription Drug Violation. Kirchner was taken to the Cass County Jail where he remains held on $3,000 bond.

On July 21, 2015, the Cass County Sheriff’s Office arrested Thomas Dale Mace, 23, of Atlantic, IA, on a charge of Serious Assault. Mace was taken to the Cass County Jail where he was released later on his own recognizance.

On July 19, 2015, at 10:51 p.m., the Cass County Sheriff’s Office responded to a report of a domestic disturbance in Anita. Upon investigation, Brandon Michael Luke, 25, of Anita, was arrested on charges of Arson 1st Degree (B Felony); Possession of Methamphetamine 3rd or Subsequent (D Felony); Child Endangerment (Aggravated); Domestic Abuse Assault (Serious); False Imprisonment (Serious); and Possession of Drug Paraphernalia (Simple). Luke was taken to the Cass County Jail where he remains held on $30,000 bond.

On July 19, 2015, the Cass County Sheriff’s Office arrested Michael Patrick McKibben, 27, of Lewis, IA, on a Ringgold County warrant. McKibben was taken to the Cass County Jail and released later that day to Ringgold County.

On July 16, 2015, the Cass County Sheriff’s Office arrested Joseph Andrew Riesberg, 22, of Audubon, IA, on a District Court warrant for Failure to Appear to Serve Sentence. Riesberg was taken to the Cass County Jail where he remains until the remainder of his sentence is served.

On July 16, 2015, at approximately 12:58 a.m., the Cass County Sheriff’s Office responded to a reported stabbing and discharge of a firearm outside of Huffy’s Bar in Anita. Upon investigation, no stabbing was found to have occurred; however, a firearm was fired outside the bar. Erich S. Johnson, 31, of West Point, NE, was subsequently charged with Possession and Control of Firearms with a Domestic Assault Conviction (D felony), Carrying Weapons (aggravated misdemeanor), and Reckless Use of a Firearm (simple misdemeanor). Johnson was taken to the Cass County Jail where he remains held on $5000 bond. The Adair County Sheriff’s Office assisted Cass County Sheriff’s Office in the investigation.

On July 14, 2015, the Cass County Sheriff’s Office arrested Nicole Amaris Bittner, 28, of Avoca, IA, on an Atlantic Police Department warrant for Theft 1st Degree (C Felony). Bittner was taken to the Cass County Jail where she was released on her own recognizance to Harrison County Sheriff’s Office the following day.

On July 14, 2015, Blake Michael Zweck, 19, of Atlantic, IA, turned himself in at the Cass County Sheriff’s Office on a District Court warrant for Probation Violation. Zweck remains held at the Cass County Jail on $10,000 bond.

On July 14, 2015, Philip Jesse Gehling, 45, of Atlantic, IA, turned himself in at the Cass County Jail on an Atlantic Police Department warrant for Burglary 1st Degree (B Felony), Going Armed With Intent (D Felony), Domestic Abuse Assault (Aggravated Misdemeanor), and Carrying Weapons (Aggravated Misdemeanor). Gehling was booked in at the Cass County Jail where he was released on $20,000 bond.

On July 11, 2015, the Cass County Sheriff’s Office arrested Heidi Lynn Murphy, 20, of Logan, IA; and Drew Ashton Gagnon, 23, also of Logan, IA, on a District Court warrants for Probation Violation. Both remain held at the Cass County Jail on $1000 bond each.
Telephone Scam
The Cass County Sheriff’s Office would like the public to be aware of a phone scam that was reported to us today wherein someone called an individual claiming to be from the office that administrates their pension fund. The scammer claimed the reporting party had been overpaid from the pension fund and owed money back, but declined to allow caller to stop at the pension office. Please make sure if you receive a call that sounds as though it could be valid to do your homework! Ask for information by mail, and, if you are able, find a number on your own for the place that is allegedly contacting you to verify the validity of the call.
Vehicle Accident
On July 9, 2015, at 10:14 a.m., the Cass County Sheriff’s Office received a report of a one-vehicle accident that had occurred at 610th Street and Keystone overnight. A 2011 Toyota owned and driven by Kevin Patrick Smith, 30, of Atlantic, IA, was found to be in the ditch at that location. A passenger in the vehicle, Emily Rebarcak, had received minor injuries as a result of the accident and was taken to CCMH to be evaluated. Upon investigation, the driver has been cited into court for OWI 2nd Offense, Carrying a Concealed Weapon, and Leaving the Scene of an Injury Accident. Damage to the vehicle is estimated to be $2,000.

On July 8, 2015, the Cass County Sheriff’s Office arrested Justin Dale Hardisty, 24, of Cumberland, IA, on a District Court warrant for Failure to Appear (Child Support). Hardisty was taken to the Cass County Jail where he remains held on $2000 bond.

On July 8, 2015, the Cass County Sheriff’s Office served two District Court warrants for Probation Violation on Alexander Paul Dvorak, 25, of Atlantic, IA. Dvorak was already held at the Cass County Jail on charges of Possession with Intent to Deliver Meth and Possession of Drug Paraphernalia. Bond on the Probation Violation warrants is $10,000 each.

On July 7, 2015, the Cass County Sheriff’s Office arrested Morgan Kay Leeder, 24, of Griswold, IA, on a Cass County Sheriff’s Office warrant for Domestic Abuse Assault (Simple) and Interference with Official Acts. Leeder was taken to the Cass County Jail where she was released later that day on $750 bond.

On July 3, 2015, Donald Leo Loury III turned himself in on two outstanding Cass County warrants for Violation of a No Contact Order and Failure to Appear. Loury was booked and released on $825 bond.

On July 2, 2015, the Cass County Sheriff’s Office arrested Alexander Paul Dvorak, 25, of Atlantic, IA, on charges of Possession with Intent to Deliver Methamphetamine and Possession of Drug Paraphernalia. Dvorak was taken to the Cass County Jail where he remains held on $10,000 bond.

On June 29, 2015, as the result of a report of the theft of a vehicle and some personal items from a rural Anita residence, the Cass County Sheriff’s Office arrested Sarah Jo Porter, 19, of Anita, IA, on charges of Burglary 3rd Degree, Theft 2nd Degree, and Possession of a Controlled Substance. Porter was taken to the Cass County Jail where she was released later that day on $7,500 bond.

On June 27, 2015, the Cass County Sheriff’s Office arrested Rebecca Ann Edwards, 28, of Puxico, MO, on charges of Assault on a Peace Office, Public Intoxication, and Interference with Official Acts. Edwards was taken to the Cass County Jail where she was released later that day on her own recognizance.

On June 26, 2015, the Cass County Sheriff’s Office arrested Wyatt Lee Sargent, 20, of Council Bluffs, IA, on a District Court warrant for Failure to Appear. Sargent was taken to the Cass County Jail where he was released the following day on his own recognizance.
Accident
On July 4, 2015, at 2:45 p.m., the Cass County Sheriff’s Office responded to a report of a one-vehicle accident on 690th Street. A 2005 Mazda driven by Sherry Lynne Castillo, 33, of Atlantic, IA, was northbound on 690th Street when the driver lost control of the vehicle, sliding into the east ditch and rolling the vehicle onto its top. No injuries were reported. Damage to the vehicle is estimated at $1,500.
Accident
On July 4, 2015, at 7:15 a.m., the Cass County Sheriff’s Office responded to a report of a one-vehicle accident on Galveston Road. A 1988 Chevy C1500 pickup owned and driven by Anthony Gail Harvey, 16, of Anita, IA, was westbound on Galveston when the driver lost control of the vehicle, coming to rest on its right side in the north ditch. No injuries were reported. Damage to the vehicle is estimated at $1,500.
Accident
On July 3, 2015, at 6:40 p.m., the Cass County Sheriff’s Office responded to a report of a two-vehicle accident on 690th Street at Memphis Road. A 2000 Honda Accord driven by Alec Lee Hayes, 17, of Atlantic, IA; and a 2004 Chevy Suburban owned and driven by Douglas John Becker, 45, of Pleasant Hill, IA, were both southbound on 690th Street when Hayes attempted a U-turn and failed to yield to Becker’s vehicle, striking it in the front driver’s side and forcing Becker’s vehicle into the southwest ditch. No injuries were reported. Hayes was cited for Failure to Yield.

On July 3, 2015, at 2:50 a.m., the Cass County Sheriff’s Office responded to a report of a one-vehicle car/deer accident on I-80 westbound near the 52 mile marker. Vijayakuma Murugesan, 37, of Omaha, NE, was uninjured. His 2009 Honda Odyssey was estimated to have received $4,500 in damage.
Accident
On June 26, 2015, at approximately 7:30 a.m., the Cass County Sheriff’s Office was dispatched to 630th Street and Oxford Road south of Atlantic for a multiple vehicle accident. Upon arrival, it was determined that there were two vehicles involved with five injured parties. All of the parties were transported to Cass County Memorial Hospital for treatment. Two of the injured were later airlifted to CHI Creighton University Medical Center with critical injuries. The three others transported to CCMH were treated and released. The Cass County Sheriff’s Office was assisted by the Iowa State Patrol, Iowa Department of Transportation Motor Vehicle Enforcement, Atlantic Police Department, and the Department of Transportation Road Maintenance Staff. The injured were treated by area Fire and Rescue Departments from Cumberland, Massena, Lewis, and Atlantic Medivac. The cause of the accident is still under investigation.
Update:
The driver of a 2000 Oldsmobile was Marli Burcham, 22. A passenger in the Burcham vehicle was 49-year-old Katherine Moore. As of Monday, June 29th, 2015, Burcham was listed in serious condition at Creighton University Hospital, and Moore was listed in critical condition, also at Creighton University Hospital.
The driver of a 2008 Ford owned by Henningsen Construction was Marlon Feltner, 64. Passengers in the Ford were 64-year-old James Mickelson and 32-year-old Zachary Frank. All three men were treated at CCMH and released.
Accident
On June 23, 2015, at 4:02 p.m., the Cass County Sheriff’s Office responded to a report of a two-vehicle accident in the alley between 4th Street and Highway 92 in Griswold. A 2013 Chevy Equinox owned and driven by Debra Lee Alexander, 58, of Griswold, IA, was backing from a residential drive into the alley when the vehicle struck a westbound 2004 Buick Lesabre owned and driven by Virginia Lou Askeland, 81, also of Griswold. No injuries were reported. Damage to Alexander’s vehicle is estimated at $2600; damage to Askeland’s vehicle is estimated at $2000.
Incident
On June 23, 2015, at 10:48 a.m., the Cass County Sheriff’s Office responded to a report of a 9-year-old child bitten by a dog in Anita. Investigation determined the child was bitten at the residence of the owner of the dog, and sustained injuries requiring medical attention. The animal was on a leash on its property at the time of incident.

On June 20, 2015, the Cass County Sheriff’s Office arrested Shane Michael Suhr, 24, of Anita, IA, on charges of Public Intoxication and Disorderly Conduct. Suhr was taken to the Cass County Jail where he pled not guilty later that day and was released.

On June 20, 2015, the Cass County Sheriff’s Office arrested Joseph Donald Fredericksen, 27, of Atlantic, IA, on a charge of Driving While Revoked. Fredericksen was taken to the Cass County Jail where he was released later that day on $1,000 bond.
Cumberland Woman Pleads Guilty to Filing a False Tax Return
Kathy Cullen admitted to failing to report funds to the IRS that she embezzled from her employer.
DES MOINES, IA – On June 17, 2015, Kathy Joan Cullen appeared in United States District Court, before the Honorable Celeste F. Bremer, and pled guilty to filing a false 2009 tax return, announced United States Attorney Nicholas A. Klinefeldt.
According to the plea agreement, Cullen embezzled money from her employer, 21st Century Cooperative. Over a period of six years, Cullen wrote over $1.3 million in checks to herself and deposited the proceeds into a personal bank account. Cullen admitted that she failed to account for the embezzled funds in her 2009 tax return.
Cullen is scheduled to be sentenced before the Honorable John A. Jarvey on October 1, 2015, at 3:30 p.m., in Des Moines, IA. Filing a false tax return carries a maximum term of three years imprisonment, up to a $100,000 fine, and up to one year of supervised release. Cullen is also required to pay restitution, in an amount ordered by the Court.
This case was investigated by the Internal Revenue Service – Criminal Investigation, and the Cass County Sheriff’s Office. The case was prosecuted by the United States Attorney’s Office for the Southern District of Iowa.

On June 15, 2015, the Cass County Sheriff’s Office arrested Amanda Corine Elrod, 26, of Omaha, NE, on a Cass County warrant for Failure to Appear. Elrod was taken to the Cass County Jail where she pled guilty and was released later that day.

On June 15, 2015, the Cass County Sheriff’s Office arrested Andrew James Roach, 19, of Griswold, IA, on charges of Contributing to the Delinquency of a Minor and Minor in Possession of Alcohol. Roach was taken to the Cass County Jail where he was released the following day on his own recognizance.

On June 15, 2015, the Cass County Sheriff’s Office arrested Tary Joseph Scholz, 50, of Lincoln, NE, on two District Court warrants, one for Burglary 3rd Degree and Criminal Mischief 3rd Degree; and one for Burglary 3rd Degree and Criminal Mischief 4th Degree, as related to area burglaries in October 2013 of car washes and laundromats. Scholz was taken to the Cass County Jail where he remains held on $11,500 bond.

On June 12, 2015, the Cass County Sheriff’s Office arrested Sean Patrick Gifford, 32, of Atlantic, IA, on charges of Possession with Intent to Deliver. Gifford was taken to the Cass County Jail where he was later released to Shelby County, where he was also wanted on a warrant.
Search
On June 7, 2015, at approximately 2:21 a.m., the Cass County Sheriff’s Office responded to a report of a 19-year-old female subject who left Valley Oil on foot, for reasons unknown, and headed east across Highway 71 into a wooded area. The subject did not cooperate with authorities who attempted to find her. After a three-hour search, the subject was located and transported to Cass County Memorial Hospital for evaluation. The Cass County Sheriff’s Office was assisted by the Iowa State Patrol, the Atlantic Police Department, and Audubon County Sheriff’s Office. The Sheriff would also like to extend special thanks to the Atlantic Firemen who volunteered to come out and assist with the search.

On June 6, 2015, the Cass County Sheriff’s Office arrested Callyn Scott Vincent Pollock, 24, of Anita, IA, on charges of OWI 1st Offense (Serious) and Driving Under Suspension (Simple). Pollock was taken to the Cass County Jail where he was released later that day on his own recognizance.

On June 5, 2015, the Cass County Sheriff’s Office arrested Daniel Floyd Edwards, 32, of Osceola, IA, on charges of OWI 3rd or Subsequent Offense (D Fel) and Driving While Barred (Agg). Edwards was taken to the Cass County Jail where he was released the following day on $5,000 bond.

On June 1, 2015, the Cass County Sheriff’s Office arrested Richard Stockton Bradshaw, 54, of Omaha, NE, on a charge of Harassment by Communication. Bradshaw was taken to the Cass County Jail where he was released later that day on $325 bond.
